In addition to the required technicity, a patent application must also fulfil further\u00a0<strong>criteria<\/strong>\u00a0in order to be considered patentable. In particular, the subject matter to be protected must be novel and must not be obvious to a person skilled in the art from the state of the art. This means that generally an invention can no longer be protected by a patent once it has been made public.<\/p>\n<p>In terms of time, the scope of protection of a patent is limited to a\u00a0<strong>maximum of 20 years<\/strong>\u00a0(calculated from the filing date). In terms of territorial scope of protection,\u00a0national patents\u00a0are available for protection in individual countries; thereby separate\u00a0grant proceedings\u00a0must be conducted before the competent patent office in each case.\u00a0With the filing of a\u00a0<strong>European patent application<\/strong>, however, it is possible to obtain protection for up to 44 countries in one single <a href=\"https:\/\/www.klimenthenhapel.at\/en\/services\/#representation-conduct-of-proceedings\">grant procedure<\/a>. This is because the\u00a0maximum <strong>term<\/strong>\u00a0of a utility model of 10 years is markedly shorter than that of a\u00a0<a href=\"https:\/\/www.klimenthenhapel.at\/en\/legal-areas\/#patents\">patent<\/a>.<\/p>\n<p>However, the utility model also offers significant\u00a0<strong>advantages<\/strong> compared with a patent: Although the criteria that a utility model has to fulfil in order to be legally valid are the same as in the case of a patent, a utility model is merely subjected to a formal examination of conformity with the law, so that markedly\u00a0<strong>shorter grant proceedings\u00a0<\/strong>can be expected. In addition, a so-called\u00a0<strong>six-month period preclusive of prejudice to novelty<\/strong> applies for utility models.
